No monetary gain will result from their appearance in my story. Author’s Note: I was so taken by the preview of the Christmas episode that I found myself writing another Harm/Mac/Mattie story. It’s different - and not different - from my last effort, “Too Much to Walk Away.” The potential interactions between these three characters is so rich in my estimation and I am fascinated by the possibilities. December 8, 2003 JAG HQ Harm’s office “Mrs. LeMoyne, I’ve promised this girl she will never have to be alone again. Are you telling me that I cannot keep the promise I made her?” “No, Mr. Rabb, I’m saying it will be an up-hill battle and you will have to do a lot of work to make it happen.” “Then tell me what I need to do so I can do it.” “Well, you will need to have your home inspected and right now it does not meet specifications so you will have to show how you will provide a home for her on a temporary basis until you can obtain a permanent home that will be approved.” Harm wrote frantically on his pad and then said, “Reasonable..what else?” “You will need to have at least three people vouch for your character...” “Would my godson’s parents, my commanding officer, and a another colleague be suitable?” “Probably...You know, if you were married or even had a significant other it would make things go much easier. Are you sure you there isn’t anyone that might be in your future that you could move the timetable up on?” she asked smiling, thinking ‘how could someone as good looking as this man, not have a woman in his life if he wanted one?’ “Look, there is someone that I care about but unfortunately she has made it clear that she doesn’t see us having a future and she is seeing someone else right now - at least I think she is. We also work together and it would complicate things if we were together. I can’t go to her and ask her to disrupt her life for me, although I think she would at least testify on my behalf. What else do I need to do?” You will need to show your financial records and prove that you are financially stable and can provide insurance coverage for Mattie; you will need to submit to a through background check; you will need at least two continency plans in place in case you are called away and you cannot take Mattie with you; and you had better be prepared to answer all questions the judge asks if we get far enough to have a hearing. As a lawyer, you should know that you cannot be evasive and your answers must be the truth - even if it isn’t what you really want to say.” “Pleading the fifth wouldn’t work in this case, huh?” Harm said smiling which reassured Mrs. LeMoyne that he was kidding with her. “Exactly. Have you ever brought Mattie to your apartment alone?” “Not at night. We did stop by for a few minutes the other afternoon. She wanted to see the place and I had to stop and grab some papers. We were in the apartment not more then ten minutes...and we were seen coming and going by the same person.” “Okay, that shouldn’t be a problem, but I wouldn’t risk it again. She can be there with a female chaperone however,” Mrs. LeMoyne cautioned. There was something about the tall naval officer that she felt was trustworthy, perhaps more then most. She also felt that the man had given up on the one woman that would make him happy and give him children of his own. She hoped she was wrong, because in her estimation this man was cut out to be a family man. “How long will this process take?” “Actually, you need to have everything in place within the week. If you are approved, then you will go before the judge on December 23.” “This will be done by Christmas?” “Possibly. Is that a problem?” “No...That would make a great gift for Mattie...to know she belongs and is part of a family again.” “I’ll be in touch with you in a couple of days so you can give me the names and addresses of the people that will testify for you. You already gave me the release so we can do the background and financial reviews. You’ve had the home visit know that it doesn’t meet code, so someone will call and go over your living arrangements for Mattie - short and long term.” “Thank you. I appreciate all the help you are giving me, Mrs. LeMoyne.” Harm watched the elevator door close and sighed, she was right, it was an up-hill battle, but one he was willing to go the distance to make happen. Mattie had stayed with Bud and Harriet since he had brought her into the city because she had to leave her home. She had enrolled and started attending school near Bud and Harriet’s. He would have asked Mac about putting Mattie up, even though things were still strained between them, because he felt that Mac would have wanted to help Mattie once she met her...but Mac had been on assignment and wouldn’t be back until later tonight or tomorrow. So he would start by talking to the Admiral, Coates, and Bud and Harriet. JAG HQ Falls Church, VA “Admiral, I’d like to speak to you about a personal matter if I might?” “What is it Rabb?” AJ Chegwidden motion Harm to be seated near the fireplace and joined him there. “Sir, you remember the young lady that I was crop dusting for when you came to see me?” “Yes...she did make quite the impression. What’s up?” “Well, as I got to know her and she came to trust me, she admitted that her mother had been killed in a car accident last spring. Her father was drunk at the time and afterward kept drinking and driving...she hasn’t seen him since.” “What does this have to do with you, Harm?” “I’m applying to be Mattie’s legal guardian.” “You’re what? You have about a snowball’s chance in hell of being approved. You’re setting both of yourselves up for disappointment. Isn’t there a family member, a grandparent, someone that could take physical custody?” “No, sir. Are you saying you think she won’t be safe with me, sir?” Harm quietly asked. “No Harm, I have no doubt that if you have come to care about this child, you will move heaven and earth to keep your promises to her and to protect her and keep her safe. I just don’t know if we can convince the courts of that.” “We sir?” “I’m assuming you would like me to vouch for you in court?” Harm grinned sheepishly, “I was hoping you would sir, but I will understand if you feel you can’t.” “Harm, you have changed a lot since your return. And whether it was my words of wisdom or the connection you made with Mattie, or just trying to save face with Mac, I don’t care. You are more thoughtful - hell, I have heard you apologize to Mac more in the past few weeks then you had in over seven years - and you have been considering the bigger picture. As a matter of fact, I am very impressed with the way you have conducted yourself over all. Some of the judges have even mentioned it to me.” “Thank you sir. I appreciate your offer of support and acknowledgment of changes I have made.” “What do you need from me, Harm, to move forward with the guardianship?” “I will give social services your name, address and phone number and they will contact you to set up an interview. They will also let you know when the court date is...they are saying it will be before Christmas.” “Harm, have you talked about your plans with Mac?” “No sir.” “May I ask why?” “Well, sir, despite my willingness to admit to Mac how I feel about her, she has moved on, I believe. I will talk to her but she was gone before I knew that things were going to progress so fast, and I feel I need to do this face to face.” “Harm, I’m not sure she has moved on. You remember when she said how Marine’s bury their feelings and don’t share what’s going on inside with just anyone?” “Yeah...” “I think Mac has been suppressing what she’s feeling. I think that is why she has lashed out at Sturgis and even Bud. I think that’s why she’s being so tough on the ones she is prosecuting and why she is so gung-ho with the ones she is defending. She can’t keep a balance and a perspective when she is fighting the odds and her feelings about everything that has gone on for her and for you.” “Admiral, I’m not sure I should be discussing Mac with you.” “I know, but we both care about Mac as a friend and as a colleague. You however, are carrying a bigger burden...you may have her heart and soul in your hands. Just think before you speak, Harm. You’ll do the right thing...you usually do...” Coates had secured before Harm left the Admiral’s office, so he went to the Robert’s home where he was greeted with open arms by Mattie and little AJ and smiles by Bud and Harriet. “Commander! Come in...” Harriet greeted him with a smile. Untangling himself for the hugs after he had returned each one, “Harm looked at Harriet and Bud, “Thank you for letting Mattie stay here the last few days. I was working on some renovations but I found out today it isn’t going to be enough...I’ve got to start house hunting.” “Really? Does that mean you are going to shelf this idea?” Mattie quietly asked. “Mattie Grace...we talked about this...you needed to have some faith in me. I am not going to back out.” Harm reached out to her and wrapped an arm around her shoulder. “We’re going to start house hunting...in the meantime, Bud, Harriet, if you can’t keep her I’ll understand...” “Harmon Rabb! How dare you even think we wouldn’t want to help out?” Harriet Sims-Roberts exclaimed. Mattie can stay here as long as you need a place...and if there is anything else we can help you do, then you ask.” “Yes, Ma’am.” Harm smiled at his friend. Harriet and he had often been able to support each other when no one else could. She was his ‘little sister’ and he her ’big brother’. There was no tension between them like had existed from day one with him and Mac. “Bud are you sure?” “Yes, sir. Mattie has been delightful and very helpful. Now, what else can we do?” “One or both of you may be called to testify as a character witness on my behalf.” Mattie scooted off with little AJ as the adults started to talk. “How will we know?” asked Bud. “They‘ll interview you both and then tell you if they want you to testify,” answered Harm. “Is Mac going to testify too, sir?” “I don’t know...she doesn’t know about Mattie yet. I don’t know if there’ll be time for me to tell her about Mattie before they would want to interview her. I’m not sure she’ll handle it well without time to think about it and maybe see us together...it’s not been a good year for us you know.” “But you are going to tell her about Mattie aren’t you sir?” “Of course Bud! I’ll tell her as soon as she gets back. I left a message for her to call me when she got in...no matter what time. I had hoped...never mind.” Harm trailed off. “You had hoped that you would be together and then you could have done this together.” Bud finished for his friend. “Yeah...but its not going to happen now I guess...at least Mac feels it can never happen.” Harriet stood up to leave the men alone with the excuse that she needed to check on the baby, “Harm, you both went through a lot this past year...don’t give up on her, sir.” Harm nodded and looked at his hands for a minute trying to will his tears back. When he had composed himself again, feeling only a bit embarrassed by his quiet show of emotion, he rose. “I’m going to take Mattie out for dinner and then I’ll bring her back before I go see if Mac is home.” 1730 EST Local Restaurant Harm and Mattie went to the Asian restaurant not far from Bud and Harriet’s house. Mattie had not had many opportunities to try Asian cuisine and this place had a buffet that Harm felt had a good variety of dishes that would work for Mattie to sample new dishes while still finding things she knew she liked. He updated her over egg rolls and crab rangoon and assured her that he would have every thing ready as they had requested. He also explained that if he did everything in his power to make this happen and the judge ruled against him, then he would find a way to stay in her life as her friend...and as long as she had a friend, she would never be alone. They were just finishing their meal when Jennifer Coates stopped by the table. “Commander Rabb...” “Hey, hi Jen. I’d like you to meet the mysterious Mattie Grace. Mattie, Petty Officer Jennifer Coates.” “Hi Mattie, nice to meet you. I understand that Commander Rabb is trying to help you. Listen to him. He gives good advice but gives you room to think it over and make up your own mind.” “I know. Are you going to testify for him?” Mattie asked. “You know, Jen, I was going to ask you earlier today, but you had secured before I left the admiral’s office. “Yes sir...the admiral let me go early today so I could do some shopping,,,for him as well as myself!” she laughed. “If I can help, I will.” “I’d appreciate it Jen.” “We both would. Did Harm help you too?” “Yup! Two years ago I was in trouble and in stead of sending me to the brig he took me with him and had me stay with Colonel Mackenzie at night. I gave him a hard time, slipped away, but he hung in there with me. Helped me to see that I need to take a closer look at what I was doing...he saved my life that Christmas.” Jen finished. “Jen you saved your own self...turned your life around and made something of yourself.” “Yes, but you and the Colonel helped me to see that I had that option.” “So I’m next in line for rescue, huh?” Mattie grinned at Harm, teasing him a little. “Looks that way.” “So who’s the Colonel?” asked Mattie. “Sarah Mackenzie works with me at JAG. We’ve been friends for a long time. She’s away on an assignment so there’s been no time for you to meet her. She should be back soon.” Mattie looked at Jen and whispered, “Is she the woman in his life? I’m sure there is one, but he’s not telling.” Jen grinned and nodded her head slightly as she said, “I wouldn’t know that about my superior officers, right sir?” “That’s right Petty Officer. Mattie are you ready?” “Guess that’s my cue. It was good to meet you, Jen.” Harm paid there tab and they left the restaurant. Just as they were settled in the car, Harm’s cell phone rang. “Rabb.” “Harm, I’m back. What’s wrong?” “Nothing bad...are you going to be home in about half and hour?” “Yeah...come over and talk to me.” “I’ll be there.” “Coffee’s on.” Harm smiled at Mattie. I’m going to drop you off at Bud and Harriet’s and then go see Mac. I’ll try to call you later if I’m not to late, otherwise, shall we do breakfast in the morning before school?” “See you at zero seven hundred, right?” Mattie asked. “Exactly. Night Mattie. Sleep tight.” “Thanks for dinner. Night Harm.” Mac’s Apartment Georgetown Harm decided to burn off some nervous energy by bounding up the stairs instead of taking the elevator. He took a deep breath and knocked on Mac’s door. She opened it almost immediately. “Hi...come on in Harm.” “Thanks for seeing me Mac.” “What’s going on?” “In a minute...how was your assignment?” “Frustrating at times but we were able to get them talking finally, and resolved the issues so that there will be no trial. And I was able to do my report while I waited for transport, and on the way home, so in about thirty minutes it will be finalized and filed. Now tell me about what’s going on with you.” “When I was fired from the CIA, I decided to go out to the airfield and tinker on my plane and spend some time in the air maybe. When I got there I found that Gus had sold out and it was now Grace Aviation. There was this spunky kid that met me and introduced herself as Mattie Grace. She’s about fourteen and right away I felt like I knew her. She helped me change the plugs and said that she wouldn’t take ‘no’ for an answer, so her father had taught her how when she was about six. Anyway, she offered me a job flying - dusting crops. Anyway, she opened up a little at a time, and I discovered that she had lost her mother in a car accident last spring. After the admiral came out and offered me a chance to return to JAG, I asked her why I hadn’t met her father, and she admitted that he had been drinking and driving the car when her mother was killed and that she hadn’t seen him since. She’s been living in the house her mother left her in the her will and running Grace Aviation on her own. Apparently the will also left her the planes. Anyway, to make a long story short, I promised her I wouldn’t abandon her and that even though I was going back to JAG, I would call her every day and come out at least once a week if I could...” “She’s the mysterious woman, isn’t she Harm?” He inclined his head to indicate that Mac was correct in her assumption. “I am applying to be her legal guardian and I need you to vouch for me?” “Harm, have you thought this through?” “Yes Mac I have...and I hope that you will meet Mattie and get to know her before you make your decision. If you don’t feel you can be a character witness for me, then I understand...but I had hoped that you would also play at least a small role in Mattie’s life. You’d be good for her...and I think she’d be good for you too.” “Harm, be practical a minute...where’s she going to sleep?” “She’s staying with Bud and Harriet right now...while I look for a house.” “You are looking for a house and are going to give up your bachelor pad loft?” “Yes...I want a family Mac, and although it may not be a traditional way to go about it, adopting a teenager, it does meet the need of two people...my need to take care of people and her need to never be alone.” “Harm I don’t know...” “Mac, I know. I hope this doesn’t come out wrong, but just listen a moment...You more or less have been in her shoes...lost a mother at fourteen; abandoned by a father that was drunk and kept on driving to get away; alone in the world; forced to grow up when you’re still a kid; in your case things got bad before your uncle stepped in to help you. Mattie has no one and I don’t want her to go through what you did. I have the desire and ability to help her. She trusts me and needs me.” “Harm, I...” “I’m sorry if I upset you Mac...” “Harm...be quiet! I see now where you are coming from. I would have given my eye teeth to have someone willing to stick his neck out for me the way you are for Mattie. You are a good person, Harm...and yes, I will vouch for you... I am surprised they would even consider you because you are single.” “Well that issue has come up. They said it would help if I even had a girlfriend and then made a few remarks as to why I don’t have a significant other.” “And what did you tell them?” Mac was a little surprised at herself for asking, but when Harm started to answer she hung on his every word. “I told them that I thought I was moving in that direction with someone, but due to complications at work; the fact that she appeared to move on; and she made it clear that she figured we could never work it out, I understood that it wasn’t in the cards.” “Harm you really told them that?” “It’s the truth.” “Harm I’m sorry. I...don’t know what to say.” “Don’t say anything right now. I hope you will vouch for me because Mattie deserves to have a family and feel like she belongs. I want to do that for her and I need you to help me make that happen...” “I will...but I need to ask you to leave now. I have some things I need to think over.” “Okay...Mac, would you like to join Mattie and I for breakfast in the morning?” “Yeah, I think I would. Where and what time?” Harm gave her the information, thanked her and left. When the door shut behind Harmon Rabb Junior, Mac fell onto the couch and stared at the door. She had a lot to think over. Harm was not living up to her preconceived ideas. In her mind, Harm would dash in, turn the girl over to Child services, call her now and then to check on her and leave it at that, once the grand gesture was done. ‘This Harm’ went out of his way to make plans, think of others, ask for help, and respect her wishes...at least the ones she had communicated. What had he told her: ‘I was moving in that direction with someone, but due to complications at work; the fact that she appeared to move on; and she made it clear that she figured we could never work it out, I understood that it wasn’t in the cards.’ Mac covered her mouth with her hands as his words sunk in. Harm was telling her that he thought they had been moving toward being together and having a family - buying a house even...she had underestimated him. She had once again decided how he thought and felt and set things up to go that way...when in fact it appeared now that she had been very wrong. “Oh Harm...I knew better then to say never...why did I do that? What ever it takes I will make this happen.” Mac didn’t think she would sleep much that night, but to her surprised she slept better then she had in months. Next Morning Breakfast Café Mac was there and seated at a table when Harm walked in with a lovely teenage girl with long wavy hair. She was dressed in a blouse, sweater and jeans, obviously ready for school. “Morning Mac. May I present Lieutenant Colonel Sarah Mackenzie. Mattie Grace Johnson.” “Good morning, Mattie. Have a seat and please call me ‘Mac’,” she invited. “Nice to meet you Mac.” Mattie sat across from Mac closest to the wall, while Harm sat directly across from her. There were a few minutes of uneasiness until they all decided to order. While they waited for their food, Harm told them that he had grabbed the real estate listings and he was hoping to look at a few houses later in the day. “So, what kind of things do you think I should look for when I screen these houses, ladies?” “It has to have at least two bathrooms,” Mattie stated. “A garage,” suggested Mac. “With a nice backyard,” added Mac. “What should the house have? I don’t care about the extras just yet.” Harm refocused them. “Lots of bedrooms, an office, a living room and a dining room,” suggested Mattie. “...and a porch,” Mac quietly added. Her eyes locked with Harm’s as a small smile spread across both faces. “Isn’t that an extra?” Mattie asked. “No...” Mac and Harm said at the same time before laughing aloud. “There’s a story here,” Mattie stated as she looked between these two adults. She felt the electricity surrounding them when they had first entered the restaurant and Harm and spotted her. Now that they were together it was almost visible. She studied the two adults as they got lost looking at each other. She had the feeling that they would have remained that way for hours had their breakfast not arrived. “So Harm, are you going to take me with you to see these places or what?” asked Mattie. “I thought I could screen them while you are in school and then Saturday set up a second visit to the ones that I think meet our expectations.” “Sounds good...seeing as it doesn’t sound like I’m going to get excused from school to do this.” “You got that message loud and clear I guess,” Harm kidded with her, pleased that she accepted his plan. “What do you say, Mac, want to look at houses with us Saturday?” “Yeah, it might be fun. Let me know where and when.” “I’ll let you know what time to expect us and we’ll pick you up, okay?” Harm asked, his voice quiet and husky. By the time they finished breakfast Mac and Mattie had discovered they could have fun gang up on Harm. They both looked forward to getting together again. Mac said she’d see Harm back at JAG before they separated. Harm took Mattie to school and then headed for his office. Thursday evening Mac’s apartment “Mrs. LeMoyne? Come in. I’m Sarah Mackenzie.” Mac greeted the woman from children’s services when she opened the door for her. “It’s nice to meet you. Shall we tour your apartment before we talk?” “Of course. It isn’t big, but I do have a second room that can be converted to a bedroom. I’ve used it as storage because I didn’t need it, but it wouldn’t take much to make it into a nice bedroom.” “Mrs. LeMoyne looked at the apartment with a critical eye and then said, “I think this would make a sufficient space for temporary living arrangements. Shall we talk about you, now?” Mac suggested they sit in the living room and offered Mrs. LeMoyne a cup of coffee which she declined. Mac was feeling a little nervous. “As you know from our phone conversation earlier this week, I need to interview you on two levels. One from the stand point of a witness and the other from the stand point of a potential guardian. Had I reviewed your records before talking to you, I would have had serious doubts about your suitability for either task. However, being in the military I know that you have had to deal with situations the civilian person would not encounter. I also know that as a military lawyer and officer you need to meet basic standard of conduct. Your records show that you are that, as is Mr. Rabb - Commander Rabb, sorry.” “So will you be able to use me on Harm’s behalf?” asked Mac. “Probably...but I have some questions for you first.” “Okay..” “Are you and Harmon Rabb involved outside of being colleagues at JAG?” “There’s not an easy answer to this...We have had a relationship based on mutual friendship for as long as we have known each other. I would not hesitate to trust him with my life nor him me. We have a connection that is more then mere friendship, but is complicated by our past experiences with others and being in the same chain of command. Have we ever been lovers? - No...but do we love each other? - yes I believe we do. Is it enough to base a permanent relationship on...I think so but we are both afraid to take that step. As a result we have recently made decisions and said things that have hurt the other.” “Do you think that is something you could get past for the common interest of a child?” “Yes.” “Why do you answer that with such conviction?” “Because I know Harm...we might argue and challenge each other and test our limits but Harm is going to do what’s right for his client and he is going to pursue the truth. We usually can work things out when we approach it as part of our job or duties. It’s only when our feelings get involved for each other that we seem unable to work things out.” “Do you see Mattie as ‘his client’?” “No...but I see us working out disagreements regarding her best interest in the same way we would at work...with her best interest in mind.” “If Commander Rabb were married or had a significant other, the judge would be more apt to consider him as Mattie’s guardian. Do you see any chance that you and he would ever have that kind of relationship?” “A year ago I would have said yes, we were getting closer to that...but I can only hope that I can repair the damage I’ve done to us, so that we can maybe consider that again.” “Are you in love with Commander Rabb?” “Yes.” “Enough to lie on his behalf?” “No. Harm would never want anyone to lie on his behalf. He stands for truth and justice. Mrs. LeMoyne, will I be asked that question on the stand?” “Probably...to establish your credibility and to also show that Harm really does have a woman in his life that could provide the female role model and guidance that a teenage girl would need. Is that a problem?” “No...I just think I’d better have a talk with him that I tabled months ago. He’s also asked me to go looking at houses with him and Mattie this weekend.” “So you are getting to know our Mattie... that’s good. She is a handful but she has connected to Harm and is much more manageable with him around.” “Harm has a way of making people feel good about themselves.” “But not always you, Colonel?” “It’s me...I don’t always trust him or I think he has ulterior motives or I get bristly and don’t allow him to do what he does best...” “What’s that?” “Take care of people.” Saturday Morning Robert’s Neighborhood Harm, Mac and Mattie were all in the SUV, parked in front of a yellow split level ranch two blocks from where Bud and Harriet lived. While they waited for the realtor, Harm told him what he remembered from his first visit. “This place had three bathrooms, two with bathtubs and showers, one with just a shower. There’s an attached garage, finished basement and a remodeled kitchen. There were lots of room on each floor so I think some could be made bedrooms and others offices.” “Harm, why would you need more then one office?” asked Mac. He shrugged and then said, “If we were to work things out, we would each need out own office space...” Mac was speechless as the realtor pulled up and they got out of the car. “Good morning! I hope I haven’t kept you waiting long.” “We just got here,” Harm told her. “This is Mac and Mattie... and Jean?” “That’s right, Harm.” the woman smiled like she wanted to devour Harm. Mac found herself gritting her teeth. Very calmly she walked to Harm’s side and looped her arm through his, “I can’t wait to see the houses, Honey. You made them all sound delightful.” The look on his face was priceless and Mattie wished she had a camera to capture it. It looked to her like she would not only be getting a new ‘dad’ but maybe a new ‘mom’ as well. She tried to hide her smile as they followed Jean into the yellow house. They entered through the front door and went upstairs to the main floor entering into a living room. To the right was a large kitchen with wall ovens, and island stove-top and counter - much like the one in Harm’s loft. There was a small kitchen table with benches on one end. The cupboards were beautiful and appeared new. There was a door from the kitchen to the dining room, and an arch entrance from the living room. The open feeling was much like Harm’s loft, which they both liked. To the left of the stairs, was a hall way and leading off of it were two bedrooms on the right overlooking the street with a bathroom between them. On the left was a master bedroom and bath with extensive walk in closets. The appeared to be newly redone as well. Down stairs, they found a third bathroom, another bedroom and two smaller rooms. Jean told them that one had been used as sewing/ironing room and the other as a tool shop. There was a family room and a utility room with a freezer, washer and dryer. A door in that room led into the two car garage. “The price has been recently reduced and it is in move in condition now,” Jean added. “It’s nice...but I think we want to see them all before we make a decision. Right sweetheart?” Harm had recovered from Mac’s ‘honey’ earlier and decided to give her a taste of her own game. Mattie silently watched the two adults who had been touching almost non-stop since they climbed out of the car. Together they left the yellow house and drove three blocks past the Robert’s house on the same street and stopped in front of a lovely white cape style house. Again they entered through the front door into a foyer that led to a living room on the left of the stairs and a kitchen on the right that led to the dining room. There was a kitchen door that led to the garage big enough for three cars and storage. The living room was large with a fireplace. A hall ran between the living room and the stairs and led to a back door. Under the stairs, there was a half bath, a door to the basement where there was a washer dryer hook-up and a recreation room that was almost finished. Up stairs there were four rooms that could be used for bedrooms or offices. There were also two bathrooms. One in the master bedroom with a large garden tub and another between two of the medium sized rooms. The fourth room was small and next to the master bedroom. Again, they were all impressed with the possibilities but no one felt that it was ‘the right one’ yet. It was almost noon when they stopped at the third and final house. It was on the road leading toward the Admiral’s house in Maclean, Virginia. It set back off the road and as they drove up, they were welcomed by a front porch with columns, making it look almost like a small plantation house. This house was colonial blue with white shutters and trim. It was smaller then Bud and Harriet’s house, but had the southern charm that came with the style house. There was a three car garage with a workroom that could be converted into an office and a utility room with a washer and dryer, leading to the kitchen. They entered through that door into a kitchen that any gourmet cook would crave, yet it was still homey with a space for a kitchen table. Mac could see Mattie doing her homework there while Harm fixed their dinner. From the kitchen they stepped into an entry way. Off one side next to the kitchen was a large formal dining room. Across from the kitchen was a living room area. At the back of the living room was a set of stairs that led to the upper level. There were three bedrooms each with it’s own bathroom upstairs. The largest had french doors that led onto a balcony overlooking the back yard and swimming pool. A door in the kitchen also revealed stairs to the basement where there was a family room, bedroom and bathroom that could be made into a separate apartment with its own outside entrance. Harm watched Mac and Mattie as they looked at this house. It was his first choice and when they turned to him he knew it was their choice too. “Jean, I think we want to make an offer on this place.” “Very well.” The paper work was completed and Harm issued her a check for the deposit. When they were all in the car again, Mac turned to Harm and asked, “I don’t want to put a damper on things, Harm, but you just bought a huge house and if the court doesn’t give you custody...” “What will I do with such a large place?” Mac nodded. “I would still buy it and move in. I want to settle down and I hope that the court will see that I can give Mattie the home she needs, but either way, it’s exactly what I want and need to provide for my family...what ever form it takes.” Harm took Mac’s hand in his as they communicated again without words. December 23 Virginia Courthouse Harm and Mattie sat together on one side of the courtroom while the lawyers for the state sat on the other side. The judge was asking the questions, and Mattie was interviewed first. “Hello Mathilda. How are you doing?” “Fine.” “This is a big day for you isn’t it?” “Yes.” “Can you tell me in your own words, why you think Commander Harmon Rabb junior should be made your guardian?” “Yes Your Honor. Harm is the first person to care about me since my mother was killed. He didn’t throw me into the system, instead he made sure that someone would keep an eye on me and then he checked in everyday that he could...he only missed calling me three times in the last two months...and that’s because he was away on assignment and couldn’t get to a phone. He hasn’t treated me like a baby but he’s guided me and made me feel that I had someone to turn to. I feel safe when I’m around him and I know I could tell him anything...even if it embarrassed him a little. He doesn’t judge me...he guides me...and made me go back to school.” “I see. Have you ever seen Mr. Rabb with a woman?” “Yes.” “Tell me about her and the situation.” “Well, Sarah Mackenzie - she told me to call her Mac- works with Harm. They’ve been friends for years. She had a tough childhood and in some ways it is much like mine. Her mother left her and her father drank. Anyway, she made some bad choices and then as she got older she got a second chance. She said she wants to be sure I do it right the first time so I can have the childhood I lost when my mother died.” “And did Harm and Mac act when they are together?” “They kid around, but you can tell they like each other.” “How?” “The way they look at each other...as if there is no one else around. Sometimes they’ll hold hands. Twice I’ve seen Harm kiss Mac’s cheek when she’s left us.” “Do they make you uncomfortable?” “No Your Honor...they make me feel like someone cares about me.” “Thank you Mathilda. You may step down.” “I have reviewed the documents and reports that have been filed on your behalf, Commander Rabb, and you still need to convince me why I can safely place a teenage girl in your custody. Can you do that?” “I believe I can your honor.” “Then let’s call the next witness.” Harriet Sims-Roberts was called first. After being sworn in, the lawyer for the state questioned her. “How long have you known Commander Rabb and in what capacity?” “I have known the Commander about eight years. We are both stationed at JAG headquarters, him with JAG and me with the Inspector General’s Office. He is my husband’s friend and like a big brother to me. He is also my first son’s godfather.” “Does he show interest in your son?” “Yes. He remembers him at holidays and spends time with him when he comes to visit. He has been busy this year and hasn’t spent as much time, but he always checks on him. My son adores him.” “Have you met, Mathilda?” “Yes...she’s staying with us until Harm’s new house is ready and the court had ruled him her guardian.” “Have you watched them together?” “Yes.” “Mrs. Roberts, if Mattie were your daughter, would you trust Harmon Rabb to give her a safe home and environment?” “Yes, sir, I would,” “Thank you Mrs. Roberts you may step down.” Harriet smiled at Harm and Mattie as she passed them. “We would like to call Admiral AJ Chegwidden to the stand please.” Admiral Chegwidden entered in his winter blue uniform and was sworn in. The judge smiled at the distinguished gentleman. Mrs. LeMoyne could almost see the Judge licking her chops as if she knew that here, she would get some damaging information on the ‘pretty boy officer’ as she had been heard to refer to Commander Rabb. “Admiral, please state your relationship with the Commander and tell us why you think he should be considered for guardianship of a teenage girl.” “I am his Commanding Officer at JAG headquarters. I’ve know him about nine years now. Commander Rabb has a reputation for up-holding the truth. He has demonstrated a high level of moral conduct and to my chagrin at times, has often proven the need to be the voice of children and adults that are down on their luck, disabled, or in some way faced with injustice. When he makes a commitment he will see it through. If he is making a commitment to this young lady, then you can be assured that he will move heaven and earth to protect and guide her.” “Admiral, it is my understanding that Mr. Rabb was out of your command for a time and only just returned a few weeks ago. In fact I believe you stated that he was ‘a maverick, not a team player, showed a remarkable lack of responsibility and ran on emotions.’ Is this true?” AJ looked at the younger man and answered, “I did say that, Your Honor.” Harm felt things sliding down hill and he glanced at Mattie and smiled reassuringly even though that wasn’t what he was feeling. “Admiral, you appear to be contradicting yourself. Can you explain?” “Yes, Ma’am. I did say those things, and I have since revised my opinion overall. He has matured and become more focused and settled since the events that prompted my tirade. He has proven me wrong on more then one occasion, which is why I even considered allowing him to return to my command.” “Admiral, tell me about the events that led up to him leaving JAG so that I can determine for myself if he is worthy of this responsibility he is requesting.” “You understand, Your Honor, that due to sensitive matters we deal with at JAG, I may have to give you sketchy information at times?” “That is understood. Please give us as much information as you can.” “As I said Commander Rabb has worked for me about nine years. About eight years ago I paired him with a female marine lawyer and they have worked together ever since. They have become very close as friends and colleagues. I had stated when I introduced them that they shouldn’t get too close as they had to work together. I watched them over the years develop a trust and a bond that only they could break...and then I realized last spring that they couldn’t even break it because after it was damaged it would heal even stronger then before. Anyway, his partner was on an assignment and was reported missing. He asked to be sent to find her. I refused. He asked for leave to find her. I refused him again. I had been questioned in regards to my objectivity with my staff and although I was cleared of any wrong doing, I was also aware that I would be watched closely for awhile. I knew my officers were close and I knew that it would be impossible for either of them to accept my decision if it was tested..and it was. When the Colonel went missing, I knew he would push me to let him go. I didn’t realize that she had become more important to him then his career or duty. Harmon Rabb has always lived by the creed, ‘Duty to country, Loyalty to family and friends.’ I saw first hand that day that he didn’t even hesitate. It was clear to him that he had to go find her. She came first. It stung that he put his colleague before his Commanding Officer, until I realized that heart does not recognize logic or command. The reason my officers had sometimes been at odds had to do with denying their hearts and accepting their duty. Day to day that was fine, but when it came to life or death, family came first. For all intents and purposes, Harmon Rabb and Sarah Mackenzie are family. They are committed to each other beyond all else. They may not have a formally recognized relationship, but they have one.” The admiral glanced at Harm who was staring at his CO trying to assimilate what he was hearing. The judge was trying to fit this information into her picture of the naval officer and how this part of his character would work for or against him becoming her guardian. Mattie was realizing that things were getting very complicated. After taking a sip of water, AJ continued. “When they returned and both came to the office asking to resume their duties, I did the hardest thing I have ever done...I not only turned down his request, I pushed him away. I knew that things were not good between them, and I thought maybe if they were away from each other they would realize how much they needed each other and finally give in to the feelings they had. Neither of them would because they were in denial of their relationship...at first. Then Harm found other work as a pilot, his other career, and instead of missing each other and growing closer and moving forward, they avoided each other. It was then that I discovered that neither of them had recognized or owned up to what they were feeling. Our entire office was off balance and out of kilter. I realized that in fact, over the years, Commander Harmon Rabb was the one that kept things moving in that office. He works harder and smarter then most people and makes everyone around him better for just trying to keep up with him. He also did so many little things for people that were not recognized until he was not there to sooth, comfort, or share the load. I began to see how wrong I was. I went to him then when I discovered that he may be in a position to return to JAG after all, and that’s when I met Mattie Grace. She’s as feisty as he is and part of me feels he deserves to see what kind of challenge he has given his mentors over the years.” Everyone laughed a little at the Admiral’s comment. After another sip of water, he continued. “I told him that if he wanted to come back, I expected him to take ownership for his actions, and do what ever was necessary to show he was a team player and not driven by his emotions. He came back and no matter what I threw at him, he took it. I told the others not to let him charm them in to doing things to help him - at first at least - because I knew they would all be carrying big loads. Harm had twice as much to do as the rest of them and he was hardly getting any sleep, but he had made a promise to Mattie that he’d call every day and try to come see her at least once a week. He still found time to try to help an elderly gentleman, only he knew he couldn’t take on the task himself. He asked around for help a second time. By this time, everyone was hurting for him because he wasn’t getting much sleep and they knew that if the situation was reversed he would have been there for them regardless. Eventually I found out about the Colonel and Commander trying to help the elderly gentleman and chastised them for leaving me out of the loop. When I said that I would help get him situated and then I was surprised at them for not bring this to me in the first place, the Commander stepped up and said he thought I didn’t want him to be helping others. He then put himself on the lone and asked if he needed to prove himself, or if he had permission to be himself. I told him to do what he does...and that’s when he asked me for help and let me see that he was feeling overwhelmed. I had assigned him even more cases to test him a day or so before, so when he asked for help I reassigned them to the Colonel to her chagrin. In the weeks that followed, I saw the two of them trying to reestablish their trust at work even though they were opposing counsel. When personal lives were touched on , I saw Harm back off immediately and apologize for his actions, even though he was taunted that it was a sign of weakness. I’ve seen him keep his promise to this young lady and I have no reason to believe that he would do anything that would not be in her best interest. This man lives to protect and serve. He thrives on being needed and in helping and will put personal commitments over career. Your honor, if I had done that when I was a young husband, I probably would still be married.” “Admiral, I have no more questions for you and I thank you for the complete, although sometimes complicated picture you presented on Harmon Rabb. You may step down.” The admiral stopped by Harm on his way out and offered him his hand. Harm shook it and with a nod, acknowledged that they would talk later. The judge stated that they would take a twenty minute break before calling the next witness. Mattie looked at Harm with tears in her eyes. She couldn’t talk but the desperation she was feeling was evident when Harm looked at her. “Hey, now...have faith...I think we’re okay,” Harm soothed her and held her hand. Mattie shook her head side to side trying to tell Harm that it was more then the trial that had her upset. She couldn’t find the words and Harm knew from experience that it was only making things worse. “Mattie, it’s more then me being your guardian - or not - that has you so upset isn’t it?” Mattie nodded. “Okay, is it because you heard some things about what I went through?” Mattie nodded a little and shrugged her shoulders. “Sort of but not quite it, huh?” Mattie’s eyes watered a little then focused on someone or something behind him. Harm turned to see Mac. He knew she had been close but as she drew closer and Mattie saw her, he was afraid that Mattie might shut down on him. “Hey, Mac...Mattie and I were just trying to sort some things out. She’s heard things about my life and that’s kind of upset her.” “I heard. Mattie, I don’t know what has been said, in the court room, but I know the Admiral was in here a long time and I suspected that you might be upset. If I can help, I will.” Mattie nodded, while Harm spoke. “Mattie’s having some trouble putting her feelings into words right now...so I’m making guesses and she’s letting me know if I’m close. Can Mac ask questions too.” Mattie’s lips tightened and then she nodded. Harm missed her non-verbal communication, but Mac did not. “Are you upset because of me?” Mac asked bracing herself for the response. Harm was about to dismiss the idea when he saw Mattie nod in the affirmative. Harm saw the tears start to slowly roll down Mattie’s cheeks and instead of moving into his arms when he opened them, she went to Mac and hugged her. Harm looked at these two women and knew that it was time for woman’s touch so he excused himself and let them be alone. Mac held the girl and said to her, “I don’t know what was said in the court room and you understand that you can’t tell me what was said, right?” Mattie found her voice enough to say softly, “ I know.” “Can you talk to me?” “Why can’t you see what he can’t say? You knew what I was feeling.” “Oh Mattie, maybe because of what I’ve been through in my life, I’m afraid to accept it at face value. I won’t deny that we have something deeper then friendship, but we are both so afraid to go any further.” “Why? Wouldn’t you rather risk it all and have it be the best thing in the world, then to never know?” Mac and Mattie sat looking at each other without speaking, letting the words soak in. “Mattie, you are a very grown-up young lady...and I think I owe you so very much. It’s going to be okay.” Mattie dried her eyes and smiled. In that instant she knew she could trust Mac and that something that she, Mattie, had said was about to make a difference to Harm’s life. Mac and Mattie went to the ladies room before meeting Harm outside the courtroom. “Everything okay?” They both smiled and nodded their heads. “Good. Shall we go in Mattie?” At her nod he pushed open the door and held it as he turned back and said softly to Mac, “What ever you said or did, thank you.” “Your welcome. We’ll talk later.” Once seated the judge asked for the next witness. Petty Officer Jennifer Coates was admitted to the courtroom. She was asked to explain her relationship to Harmon Rabb as the others had been. She told the story that took place two years previously, when she had met him as her defense attorney. How he had tried to find a place for her and saw through her attempts to slip past him. She told about the humiliation her father had inflicted in front of Harm and although he could have left her there anyway, he recognized that it was not in her best interest and so he took her to his partner, Colonel Mackenzie. He asked that the Colonel watch her at night while he took responsibility for her during the day. When he needed to leave her, the Colonel would step in. Between the two of them, they had gotten to know her as a person. They did not judge her and they showed her that she had more choices then she thought. “Your Honor, I was a brat before I met Commander Rabb and Colonel Mackenzie.” she paused while everyone smiled. “They saw the good in me and made me feel a part of their family circle. They showed me that a good person could do bad things or good things and it was whether they learned from their mistakes and faced the consequences of their action that made the difference. I owe both of them for the life I have now. Without their guidance, I would probably be in jail or dead. Instead I have been given another chance and I have made something of myself. I am taking courses to become a psychologist some day.” “With friends like this, that could be handy,” the judge muttered as she looked over her notes. “Last spring you testified in court against the Commander, did you not?” “Yes, Ma’am.” “Yet you say you owed him. Why would you testify against him?” “I was subpoenaed Ma’am and I wanted to lie about something I had seen and what I felt about it, but Commander Rabb has always said that the truth is the most important thing. I hesitated on the stand and looked at him. He nodded his head and I knew he wanted me to be honest. I did and he praised me for it later even though at the time it hurt his case.” “I understand that he was cleared of all charges in the case.” “Yes Ma’am.” “Thank you Petty Officer Coates. Your record before meeting Commander Rabb and Colonel Mackenzie has certainly improved. I would say that if you are any indication of the kind of guidance Mathilda will get, then she might be in good hands after all. You are dismissed.” Mattie, Harm and Jen all shared smiles as she passed them to join the Admiral who was now seated behind them awaiting the outcome of the trial. “ I would like to have Colonel Mackenzie join us now please.” Mac entered the courtroom and Harriet and Bud slipped in behind her to join the others wanting to know if their family circle would increase by one. After Sarah Mackenzie was sworn in she was asked to explain her relationship to Harmon Rabb. “I have worked with Commander Rabb for eight years. During that time we have become friends and like any friends, we have had our ups and downs. A few years ago I realized that there was more to my feelings for him, then what he apparently had for me. I suggested that we have a fling and he turned me down saying he wasn’t ready for a physical relationship with me then. I was miffed and a little embarrassed so I sought solace with another man that told me over and over that he wanted me and loved me. Harm couldn’t understand what I saw in the other man and I had decided that although Harm’s friendship was all I would have, it was better then nothing. He was seeing someone too around the same time and we use to do things together as couples. Of course, because we worked together and often were sent off on assignments together all over the world, it sometimes created problems with our significant others. Eventually I became engaged to this other man and I expected Harm as my friend to share my joy. He seemed to most of the time although sometimes he would tell me he didn’t know what I saw in Mic. At our engagement party we stepped out on the porch to wait for his date and talk about a case. We got to talking about our relationship and how Harm had been the one to prevent us from crossing the line. I decided that now I was really moving on, I would try to get some answers to questions that had always bothered me. To make a long story short, we talked about a lot of things that night and I realized that Harm and I would always have a bond that would defy explanation. We cared about each other in some ways more then anyone else in our lives, yet as Harm had put it, working together certainly complicated things. After my engagement party, I realized that Harm was backing away from what he felt because he wanted me to be happy and he respected my decision. I, however, began to question if the man I was engaged to marry was the man that could make me happy. The night before my wedding, Harm was flying back from a carrier in a storm and his plane went down. I was devastated. I realized then that I felt much more deeply for Harm then I did my own fiancé. There was no doubt in my mind that the wedding would be postponed until my friend could be there for it...only my fiancé realized that I cared more for my friend then my fiancé and he broke it off after a few weeks and left. I was devastated because I felt that Harm would never be ready to make a commitment and I didn’t want to be alone anymore. Harm was still involved with someone and I didn’t want to come between them, so I left to take an assignment on a carrier for a few months. Harm came to see me and I asked him what he would give up to have me? I asked him if he would give up his girlfriend...he didn’t answer right away so I walked away...he came after me but we never got back to that conversation. After I got back to JAG, Harm and I eventually started to spend time together. We grew closer again. Neither of us had a significant other in our life. We spend time together at work and on our own. We went on assignments together and face danger and challenges that were exciting. Then after surviving a few close calls on one assignment, we found out that a friend and fellow officer had been critically injured by a mine...only days after Harm had come out unscathed from an incident with a mine. We were so close. Harm was so strong for Petty Officer Coates and myself, never letting us give up on Lt. Roberts. When we finally got word that he was going to make it, Harm collapsed. Harm doesn’t show emotion or weakness that often, but he collapsed afterward and let me comfort him. We were as close as we had ever been that day.” Mac glanced at Harm then and saw the shimmer of tears in his eyes that matched the one she knew were in hers. “That experience seemed to shake us both. We started hiding our feelings from each other about lots of things. We both had to preside over cases at JAG while the other served as counsel. JAG was under scrutiny and a report was filed stating that we had been on unchaperoned assignments together. We both laughed because over the years we have shared state rooms and hotel rooms and never have we crossed the line in those circumstances. For some reason, no one believed us and we thought it was funny. Anyway, as a result of that investigation, Harm ended up being set up and accused of murder. He was cleared on all charges. He had just gotten home and was returning to work when I was sent on a dangerous mission. He didn’t want me to go, but I was fed up with him trying to hold on to me without committing to me...so I went anyway. “I found myself in over my head and I can’t tell you a lot of what I went through but Harm showed up in the nick of time and saved my life. I was so happy to see him, but he was focused on the task at hand and went on with business as usual so there was no time to express my appreciation. The man I had been on assignment with had been injured trying to protect me, and as they were taking him away, I kissed him good-bye not knowing if he would make it or not. Harm and I completed the assignment as best we could. Later I found out that he had resigned his commission to come find me...I realized that I had the answer to my question from almost two years previously. He would give up everything for me. I was in shock from what I’d been through and instead of acting with gratitude, I basically told him it was a stupid thing to do. He thought that I was involved with the man I had been on assignment with and therefore not interested in what he had to offer...so he shut down. We both were handled that experience with less finesse then I would have liked, and I fully expected that he knew the Admiral would take him back as soon as we returned, with little more then a reprimand and maybe forfeiture of pay. We were in an emotionally charged situation, exhausted and unsure of where we stood. We lashed out at each other and put up our protective walls. I decided that it would never work for Harm and I to have any more then friendship and I told him it would never work with us. I turned and left. When we got back to JAG, the admiral threw us both by refusing to rescind Harm’s resignation. He was out. He was hurt and he stayed away from us to get on with his life.” Mac was exhausted from her story and with tears in her eyes she looked at Harm and said, “I never meant to kill our friendship.” Harm closed his eyes and swallowed. He felt a small hand take his and pat it and he turned to look at Mattie and the comfort she offered. The judge also saw the gesture and smile of reassurance the naval officer offered the girl. “Colonel Mackenzie, if Commander Rabb was married or had a significant other in his life, it would help his case. In your interview you said that you would help anyway you could. Do you love Commander Rabb?” “Yes.” “And do you see yourself ever being able to fill the role of girlfriend or wife in his life?” “Yes.” “I see. Well, I don’t usually turn my court room into a soap opera but I made an exception in this case because I feel that both of you have something important to offer this young lady. In order for that to happen, there are some things that need to be resolved before I make a final decision in this case. Commander Rabb, would you be willing to meet with me in my chambers along with Colonel Mackenzie?” “Yes your Honor.” “Colonel?” “Yes, Ma’am.” “Colonel, Commander, meet me in chambers please. This court is in recess until one o’clock this afternoon.” Mac stepped down and walked toward Harm. He stepped out to meet her, reached for her hand and quietly said, “Me too.” Mac smiled and squeezed the hand holding hers. Together they went to the see the judge in chambers. “I’m sorry Colonel Mackenzie for putting you in a situation where you stated publically what belongs in a very special and private moment. Commander Rabb, I hope that you will not hold it against her for saying in public what she had not send to you in private.” “No Your Honor...I feel the same way about her and although I would have preferred that we could say this to each other on our own I think perhaps we needed something to move us forward.” “Very well...I am going to leave you together to talk about this while I get some lunch for us. I will return.” “Mac, I want us to try to work things out. I want you and I to officially be a couple. The admiral will help us deal with the career concerns we have had. I am ready to make a commitment and I have never thought of anyone but you as the mother of my children. I want to keep the promise I made to you about going halves on a kid...and I don’t mean Mattie. I want to marry my best friend.” Mac didn’t speak. She stood up and put her arms around Harm’s neck, sliding on to his lap. They just held each other for a few minutes until Mac smiled at him and said, “I’d like that too. You know, at some point we are going to need to deal with the physical aspects of this relationship.” Harm smiled and kissed her in a lingering, soul searching kiss. They both experienced racing pulses and shortness of breath. Leaning their foreheads together they relaxed together a moment. “Can I move in with you in that new house?” “I hoped you would.” “Can we share the master bedroom or do we need to keep our distance just in case?” “We share...we’ve got to make up for lost time.” “Will they allow that if Mattie is living with us?” “I think so, but we can ask the judge. She should be returning soon.” Mac stood and straightened her uniform. Harm did the same. He planted one more quick kiss on her lips before resuming his seat just as the judge returned with lunch for them. “So, what have you to tell me?” asked the judge. “Ma’am, now that we know how we feel, we want to resume our relationship. We looked at a house and I have made an offer on it that was accepted. It will be awhile until we can move in, but Mac will be living with me and we are going to make plans to marry. I hope that this will not have a negative impact on guardianship for Mattie. She is a part of our family with or without the legal responsibilities.” “Are you saying that you don’t care what I decide?” “No Ma’am. I want you to grant legal guardianship and physical custody to both Sarah Mackenzie and myself. I’m just saying that if you decide that it is not in Mattie’s best interest, we will not wash our hands of her. She will be included in our plans and always welcomed to join us.” “Commander and Colonel...I think we should return to the court so I may render my decision...and congratulations.
